Welcome to The Monthly Soup.These Terms & Conditions ("Terms") govern your use of our websiteat themonthlysoup.com and our services (collectively, the "Service").
The Monthly Soup is operated byThe Monthly Soup, a company registered in France ("we","us", "our").
By accessing or using ourService, you agree to be bound by these Terms. If you do not agree, please donot use our Service.
The Monthly Soup is acollaborative newsletter platform that allows groups of friends and family tocreate and share monthly newsletters. Users can:
• Create and manage newsletter groups ("Soups")
• Answer questions and contribute content to newsletters
• Share text, photos, and links with group members
• Invite others to join their newsletter groups
You must be at least 13 yearsold to use our Service. If you are between 13 and 18 years old, you must haveyour parent or legal guardian's permission to use the Service, and they mustagree to these Terms on your behalf.
By using the Service, yourepresent and warrant that you meet these eligibility requirements.
To use certain features of theService, you must create an account. You agree to:
• Provide accurate and complete information
• Keep your account information up to date
• Maintain the security of your account
• Notify us immediately of any unauthorized access
You are responsible for allactivities that occur under your account.
We offer a 30-day free trialfor new users. At the end of your trial period, you will need to subscribe to apaid plan to continue using premium features.
We offer monthly and annualsubscription plans. Prices are displayed on our website and may be updated fromtime to time. Any price changes will not affect your current subscriptionperiod.
All payments are processedsecurely through Stripe. By subscribing, you agree to Stripe's terms ofservice. We do not store your complete payment card details.
Subscriptions automaticallyrenew at the end of each billing period unless you cancel before the renewaldate. You can cancel your subscription at any time through your accountsettings.
Due to the digital nature ofour Service, we generally do not offer refunds. However, if you experiencetechnical issues that prevent you from using the Service, please contact us andwe will work with you to find a solution.
You retain ownership of allcontent you submit to the Service, including text answers, photos, images, andlinks ("User Content"). By submitting User Content, you grant us anon-exclusive, worldwide, royalty-free license to use, store, and display yourcontent solely for the purpose of providing the Service.
You agree not to submit UserContent that:
• Is illegal, harmful, threatening, abusive, or harassing
• Infringes on intellectual property rights of others
• Contains viruses or malicious code
• Violates the privacy of others
• Is spam or unsolicited advertising
• Is otherwise objectionable or inappropriate
We reserve the right to removeany User Content that violates these Terms or that we deem inappropriate,without prior notice.
When using our Service, youagree not to:
• Violate any applicable laws or regulations
• Impersonate others or provide false information
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated systems to access the Service withoutpermission

The Service, including itsdesign, features, and content (excluding User Content), is owned by The MonthlySoup and is protected by copyright, trademark, and other intellectual propertylaws. You may not copy, modify, distribute, or create derivative works withoutour prior written consent.
Your privacy is important tous. Our collection and use of personal information is described in our PrivacyPolicy, which is incorporated into these Terms by reference. By using theService, you consent to our data practices as described in the Privacy Policy.
You may terminate your accountat any time by using the account deletion feature in your settings or bycontacting us. Upon termination, your right to use the Service will ceaseimmediately.
We may suspend or terminateyour account if you violate these Terms, engage in fraudulent activity, or forany other reason at our sole discretion. We will make reasonable efforts tonotify you before termination, except where prohibited by law or where immediatetermination is necessary.
Upon termination, your UserContent may be deleted. If you are a newsletter administrator, your newsletterand all associated content may be deleted. We are not obligated to retain yourdata after termination.
THE SERVICE IS PROVIDED"AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND,EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OFMERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that theService will be uninterrupted, secure, or error-free. We are not responsiblefor User Content posted by other users.
TO THE MAXIMUM EXTENT PERMITTEDBY LAW, THE MONTHLY SOUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL,SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS ORREVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
Our total liability for anyclaims arising from or related to the Service shall not exceed the amount youpaid us in the twelve (12) months preceding the claim.
You agree to indemnify and holdharmless The Monthly Soup, its officers, directors, employees, and agents fromany claims, damages, losses, or expenses (including legal fees) arising fromyour use of the Service, your User Content, or your violation of these Terms.
These Terms shall be governedby and construed in accordance with the laws of France, without regard to itsconflict of law provisions. Any disputes arising from these Terms or your useof the Service shall be subject to the exclusive jurisdiction of the courts ofFrance.
We may update these Terms fromtime to time. If we make material changes, we will notify you by email or byposting a notice on our website. Your continued use of the Service after suchchanges constitutes acceptance of the updated Terms.
Entire Agreement: TheseTerms, together with our Privacy Policy, constitute the entire agreementbetween you and The Monthly Soup.
Severability: If anyprovision of these Terms is found to be unenforceable, the remaining provisionswill remain in effect.
Waiver: Our failure toenforce any right or provision of these Terms will not be considered a waiverof those rights.
Assignment: You may notassign or transfer these Terms without our prior written consent. We may assignthese Terms without restriction.
